Terms of Service — Daily Affirm
1. Who We Are
Daily Affirmations: Widget ("Daily Affirm," "the App," "we," "us," or "our") and the website dailyaffirm.app are operated by Roman Samoilenko, a Ukrainian sole proprietor (FOP) trading as TidyBit ("Developer"). Contact: support@dailyaffirm.app.
The geographic trader address and telephone number required under EU DSA Art. 30(5) are published in the "Developer Contact" section of our App Store and Google Play product pages.
2. Agreement to These Terms
By downloading or using the App, or using this website, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the App or the site. You must be at least 13 years old to use the App, or older where your country sets a higher age of digital consent (16 in some EU member states). If you are under that age, a parent or guardian must agree to these Terms on your behalf and supervise your use.
Your use of the App is also subject to the platform rules of the store you installed it from — Apple's Licensed Application End User License Agreement or Google Play's Terms of Service. Where those platform terms conflict with these, the platform terms control for matters the platform governs (such as payment processing and refunds).
3. The App
Daily Affirm shows a daily affirmation through home-screen widgets and in the app. It works offline, requires no account, and stores your data (favorites, custom affirmations, preferences) locally on your device, as described in the Privacy Policy.
The free tier is fully usable and may show banner advertising. A single one-time, non-consumable purchase ("Premium") unlocks all visual themes and categories, removes banner ads, and enables writing your own affirmations. Premium is offered at three price points that all unlock exactly the same features — you pick whichever feels fair. Premium is not a subscription and never renews.
4. Purchases, Restores and Refunds
All purchases are processed by Apple or Google; we never see your payment details. Premium is tied to the store account you bought it with: reinstalling the App or moving to a new device restores it through the store's normal restore mechanism ("Restore purchase" in the App's settings).
Refunds are handled by the platform under its own rules: for the App Store through Apple's refund process, and for Google Play through Google's refund process. We cannot issue platform refunds ourselves, but if something went wrong with your purchase, contact us and we will do our best to help.
Right of withdrawal (EU, EEA and UK consumers). Consumers in the EU, EEA and the UK normally have 14 days to withdraw from a distance contract for digital content. Premium is delivered immediately, the moment the store confirms your purchase: by completing the purchase you expressly request that immediate delivery and acknowledge that you lose your right of withdrawal once delivery has begun. This does not affect your statutory rights if the App is faulty or does not match its description, and it does not limit any more generous refund the store chooses to grant under its own policy.
5. Your License to Use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial use.
You agree not to: copy, resell, sublicense or redistribute the App or its content libraries; extract, scrape or bulk-export the affirmation libraries for use outside the App; reverse-engineer the App except where the law expressly permits it; or use the App in any unlawful way.
6. Content and Intellectual Property
The App, this website, and all affirmation libraries — 1,190 original lines in each of eighteen languages — are the intellectual property of the Developer. Sharing individual affirmations socially (for example via the App's own Share feature, or quoting a line with attribution) is welcome. Republishing the libraries wholesale is not.
7. Your Content
Custom affirmations you write belong to you. They are stored locally on your device (and in your own device backup), are never uploaded to any server we operate, and we claim no rights over them.
8. Not Medical Advice
Affirmations are short statements of encouragement intended for general well-being. The App does not provide medical, psychological or therapeutic advice, is not a substitute for professional care, and is not a crisis service. If you are experiencing a mental-health emergency, contact a qualified professional or your local emergency services.
9. Disclaimer of Warranties
The App and the website are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
10. Limitation of Liability
We build Daily Affirm with care, but no software is perfect. To the extent the law allows, we are not responsible for losses that don’t come directly from using the App — for example lost profits, or lost data caused by events outside the App. For anything we are responsible for, our total liability is limited to the amount you paid for the App. None of this limits rights that consumer law gives you which cannot be waived.
11. Changes to the App and to These Terms
We may update the App, add or remove features, or discontinue it. We may also update these terms; when we do, we will update the "Last updated" date above, and for material changes we will provide notice in the App or in store listing notes. Continued use after changes take effect constitutes acceptance.
12. Termination
You can stop using the App at any time by uninstalling it. We may suspend or terminate the license of anyone who materially breaches these terms. Sections 6–10 survive termination.
13. Governing Law
These terms are governed by the laws of Ukraine, without prejudice to any mandatory consumer-protection rules of the country where you live, which continue to apply.
